The Technical Regulations of the Customs Union "Road Safety" (TR CU 014/2011) have priority over national legislation on the basis of Part 4 of Article 15 of the Constitution of the Russian Federation.
Article 4 of TR CU 014/2011 establishes a mandatory requirement: "Compliance of highways and road structures on them with this technical regulation is ensured by the fulfillment of its safety requirements directly or by the fulfillment of the requirements of international and regional standards, and in their absence – national (state) standards of the member states of the Customs Union, as a result of the application of which compliance with the requirements of the adopted technical regulations of the Customs Union and necessary for the implementation of conformity assessment (confirmation)".
Based on the above, in the Russian Federation, interstate standards that meet the requirements of TR CU 014/2011 have priority requirements on public roads.
Notes:
1. It should be borne in mind that certain requirements that are not established in interstate standards included in the evidence base of TR CU 014/2011, or contained in them in the form of blank norms, can be established in national standards that are being developed in the development of standards, the application of which ensures compliance with the requirements of TR CU 014/2011, taking into account regional design features, reconstruction and operation of highways and road structures.
2) When making a decision, it is also necessary to take into account the provision of the Federal Law "On Standardization in the Russian Federation" dated 06/29/2015 No. 162-FZ (paragraph 2 of Article 4), which establishes the mandatory application of standardization documents included by the Government of the Russian Federation in the list of documents whose application ensures road safety during its organizations on the territory of the Russian Federation. Decree of the Government of the Russian Federation No. 2438-r of November 4, 2017 approved a list of standardization documents, the mandatory application of which ensures road safety when it is organized on the territory of the Russian Federation. This list includes both interstate and national standards.
In accordance with GOST R 52289-2019 (paragraph 8.1.3), lighting poles refer to massive obstacles. Taking into account the requirements of GOST 52289-2019 (paragraph 8.1.6, group E), road barriers should be installed in front of such obstacles in settlements if they are located at a distance of 4 m or less from the edge of the carriageway.
In localities, for fencing lighting poles or traffic light poles (columns), which are also massive obstacles, it is possible to use curb fences as road fences in accordance with the requirements of GOST R 52766-2007 (paragraph 4.6.1.10). In other cases provided for the installation of road barriers according to GOST R 52289-2019 (Section 8) in settlements and outside settlements, barrier, parapet, cable or combined types of road barriers for cars should be used.
To install curb fences, side stones should be used according to GOST 32961-2014.
Comment. Currently, work is underway to revise GOST 33127-2014 and GOST 33128-2014, during which the issue of supplementing the list of types of road fences with curb-type fences and requirements for them is being considered. How to be guided on the road network in settlements when assigning the parameters of the entrance "pockets" of stopping points: clause 5.3.3.4 GOST R 52766-2007 "Public roads. Elements of the arrangement. General requirements" or item 6.25 of SP 396.1325800.2018 "Streets and roads of settlements. Rules of urban planning design"?
According to Part 2 of Article 4 of Federal Law No. 162-FZ of 29.06.2015 "On Standardization in the Russian Federation", standardization documents included in the list of standardization documents determined by the Government of the Russian Federation, the mandatory application of which ensures road safety when it is organized on the territory of the Russian Federation, are mandatory for use.
Clause 5.3.3.4 of GOST R 52766-2007 is included in such a list approved by the Decree of the Government of the Russian Federation No. 2438-r dated 04.11.2017 (hereinafter referred to as the Mandatory List).
SP 396.1325800.2018 is included in the List of documents in the field of standardization, as a result the application of which on a voluntary basis ensures compliance with the requirements of Federal Law No. 384-FZ dated 30.12.2009 "Technical Regulations on the safety of buildings and structures", approved by Order of Gosstandart No. 687 dated 02.04.2020 (hereinafter referred to as the Voluntary List).
According to clause 4 of Article 16.1 of Federal Law No. 184-FZ of 27.12.2002 "On Technical Regulation", the application on a voluntary basis of standards and (or) sets of rules included in the Voluntary List "is a sufficient condition for compliance with the requirements of the relevant technical regulations. In the case of application of such standards and (or) sets of rules to comply with the requirements of technical regulations, the assessment of compliance with the requirements of technical regulations may be carried out on the basis of confirmation of their compliance with such standards and (or) sets of rules. The non-application of such standards and (or) sets of rules cannot be assessed as non-compliance with the requirements of technical regulations."
The requirements of clause 5.3.3.4 of GOST R 52766-2007 are mandatory, and the requirements of SP 396.1325800.2018 are applied on a voluntary basis on the basis of, and in case of contradictions between the specified documents, the requirements of GOST R 52766-2007 have priority.
Is it necessary to re-install signs 3.24 "Maximum speed limit" after the "t-shaped" intersection of a paved road on which a speed limit has been introduced using a road sign 3.24, and a dirt road on which a sign 2.4 "Give way" is installed before the intersection according to paragraph 5.3.6 of GOST R 52289-2019?
According to paragraph 5.4.30 of GOST R 52289-2019, the sign 3.24 must be re-installed after the end of the settlement or directly behind the intersection, if necessary, to maintain the restrictions imposed by the sign installed respectively before the intersection or the end of the settlement.
Based on the definition of the term "Crossroads" (paragraph 1.2 of the Rules of the Road of the Russian Federation (hereinafter – Traffic Regulations), exits from adjacent territories are not considered intersections.
According to the definition of the term "Adjacent territories" (paragraph 1.2 of the traffic Regulations), the adjacent territory is the territory directly adjacent to the road and not intended for through traffic vehicle movements (courtyards, residential areas, parking lots, gas stations, enterprises, etc.).
The road sign 2.4 "Give way", installed according to paragraph 5.3.6 of GOST R 52289-2019, giving the intersection signs of an intersection for drivers moving along a secondary road, at the same time does not make it so for drivers moving along the main road, due to the absence of signs for these drivers informing about their priority right of way or equivalence of this intersection.
Thus, the described intersection scheme is not an intersection. However, the need to install signs 3.24 depends on whether the abutment (which has a dirt surface) is an exit from the adjacent territory. If it is, then it is not necessary to install signs 3.24.
The sign 6.22 "Photovideofixation" is allowed to be installed within the boundaries of a locality to inform about the possible use of stationary or mobile special technical means operating in automatic mode, having the functions of photo and film shooting, video recording for fixing violations of traffic rules established outside the locality, the control zone of which begins at a distance of less than 150 m after the end of the locality, including and based on paragraph 4.1 of GOST R 52289-2019. In accordance with this paragraph, technical means of traffic management are allowed to be used in cases not provided for by this standard, if their use is necessary for the purposes of ensuring safety and traffic management.
What is the system of separation of oncoming traffic directions, which must be equipped with four-lane highways in order to implement the Action Plan of the "road map" approved by Deputy Prime Minister of the Russian Federation M.Sh. Khusnullin 09.10.2020 № 9421p-P16?
The system of separation of oncoming traffic directions (hereinafter referred to as the separation system) should be understood as the physical separation of oncoming traffic flows, made in the form of an obstacle system that does not allow, without any damage to the vehicle or without its increased vibration, departure in a prohibited place on the opposite side of the road.
In accordance with interstate and national standards in the field of road safety, for the physical separation of traffic flows of opposite directions on highways, including road sections of four-lane roads without a dividing strip, can be used various systems that prevent the vehicle from leaving on the opposite side of the road, in particular by creating a structurally allocated dividing strip.
A structurally allocated dividing strip is a road element separating adjacent carriageways, allocated with the help of one or more of the following elements of arrangement: road fences, curbstone, guiding devices, anti–glare screens, as well as a lawn and marked with marking lines 1.2. (definition of the term according to GOST R 52289-2019). The presence of markings 1.2 for the allocation of the dividing strip is a prerequisite in accordance with the Rules of the road of the Russian Federation.
The most effective separation system is the device of a structurally allocated dividing strip on four-lane roads, using cable fences or barrier fences with a detachable beam without a console, installed according to GOST R 52289-2019, together with CD 5 and (or) CD 6 retroreflectors, since such a system provides holding the car in case of an accident.
A less effective separation system is the device of a structurally allocated dividing strip with the formation of a lawn, which can be allocated using a curb stone or the following elements of arrangement: guiding devices (road signal columns of group P or CD 3 retroreflectors) or noise strips; or marking lines (1.2 or 1.3) with a structural (profile) surface.
At the same time, guiding devices and noise strips are used in accordance with GOST 33151-2014 "Public automobile roads. Elements of the arrangement. Technical requirements. Rules of application", and road markings – in accordance with GOST R 52289-2019.
In addition, sets (not an exhaustive list) of typical obstacles are offered, including options for structurally allocated dividing lanes for the physical separation of traffic flows of opposite directions on four-lane roads:
- style="text-align: left;" align="justify"> cable fence, CD 6 retroreflectors and marking lines 1.2;

barrier fencing with a detachable beam without a console, CD 5 retroreflectors and marking lines 1.2;

road signal columns of group P and marking lines 1.2;

road signal columns of group P placed on delineators and marking lines 1.2;

anti-glare screens, retroreflectors CD 1 (CD2) and marking lines 1.2;
-
CD 3 retroreflectors and marking lines 1.2 or 1.3;
-
lawn or tile, curb stone and marking lines 1.2 with a structural or profile surface;
-
marking line 1.3 with a noise band along the axis of the marking line;
-
marking lines 1.3 with a structural or profile surface.
In general, railway crossings are equipped with road signs in accordance with paragraphs 5.2.5–5.2.7 and Figure B.3 of GOST R 52289-2019 "Technical means of traffic management. Rules for the use of road signs, markings, traffic lights, road barriers and guiding devices".
In accordance with paragraph 5.2.7 of GOST R 52289-2019, road signs 1.4.1 and 1.4.4 "Approach to a railway crossing" are installed with the first (main and duplicate) sign 1.1 "Railway crossing with a barrier" or 1.2 "Railway crossing without a barrier", signs 1.4.3 and 1.4.6 – with a repeated sign 1.1 or 1.2, and signs 1.4.2 and 1.4.5 – independently, at an equal distance between the first and repeated sign 1.1 or 1.2.
However, in accordance with the requirements of paragraph 5.2.4 of GOST R 52289-2019, road signs 1.1 and 1.2 are not re-installed in settlements, except for the cases specified in paragraph 5.2.3 GOST R 52289-2019.
Thus, road signs 1.4.1–1.4.6 are installed in front of each railway moving in localities, in places where the conditions for their installation are met, that is, if there are duplicate and repeated signs 1.1 or 1.2, otherwise – road signs 1.4.1–1.4.6 are not installed in localities.
GOST R 52289-2019 does not require the installation of restrictive pedestrian barriers between the carriageway and the sidewalk, if they are separated by a lawn with a width of more than 1 m, as well as on lawns of any width in the absence of sidewalks on them.
On the sidewalk, as well as on the lawn with a width of 1 m or less, which separates the carriageway from the sidewalk, limiting pedestrian barriers are installed for at least 50 m in each direction:
1) from all regulated ground pedestrian crossings;
2) unregulated ground pedestrian crossings located on sections of roads or streets:
- passing along children's institutions;
- places of concentration of accidents related to hitting a pedestrian;
- where the intensity of pedestrian traffic exceeds 1000 people/h per lane of the sidewalk with a permitted stop or parking of vehicles and 750 people/h ‒ with a prohibited stop or parking lot.
At the same time, it is allowed to reduce the length of the limiting pedestrian fences before the start of the stopping area, if there are stops of route vehicles within 50 m, and to interrupt these fences by the width of entrances (exits) to adjacent territories.
Instead of limiting pedestrian fences, it is allowed to use a continuous planting of shrubs with a height of no more than 0.8 m.
GOST R 52289-2019 does not contain requirements for the need to dismantle the restrictive pedestrian fences installed earlier according to GOST R 52289-2004.
Decree of the Government of the Russian Federation No. 2441 of December 31, 2020 amended Appendix 1 to the Rules of the Road of the Russian Federation, according to which, from March 1, 2021, a new road sign 6.22 "Photovideofixation" is found in Russia, and the existing additional information sign (plate) 8.23 "Photovideofixation" is abolished from September 1, 2021 G.
What should the new sign look like, where and how should it be installed?
Answer:
Pursuant to paragraph 2 of the Decree of the Government of the Russian Federation dated 31.12.2020 No. 2441 "On Amendments to Annex 1 to the Rules of the Road of the Russian Federation and the Invalidation of Certain provisions of Certain Acts of the Government of the Russian Federation", amendments to the relevant standardization documents were prepared and approved: GOST R 52290-2004 "Technical means of traffic management. Road signs. General technical requirements" and GOST R 52289-2019 "Technical means traffic management. Rules for the use of road signs, markings, traffic lights, road barriers and guiding devices".
The amendment to GOST R 52290-2004 contains an image of the sign 6.22 "Photovideofixation", which is similar to the image of the excluded sign (plate) 8.23 (black camera on a white background).
The amendment to GOST R 52289-2019 contains the rules for the use of the sign 6.22 "Photovideofixation", according to which this sign is installed outside settlements at a distance of 150 to 300 m to the control zone of stationary or mobile special technical means operating in automatic mode, having the functions of photo and filming, video recording for fixing violations of traffic rules, and in settlements - with signs 5.23.1, 5.23.2 and 5.25 ("The beginning of the settlement").
The sign 6.22 "Photovideofixation" is installed both independently (on an independent support) and with other signs, in this case it is allowed to be placed under existing signs without taking into account the requirements of paragraph 5.1.8 of GOST R 52289-2019 in height sign installations.
The sign 6.22 is also allowed to be installed with plates 8.1.1, 8.1.3 and 8.1.4 ("Distance to the object").
These amendments are posted on the official website of Rosstandart (www.rst.gov.ru ) On March 2, 2021 and will be published in the information index "National Standards" of IUS No. 4-2021.
The question is not clear. According to the rules of pricing and estimated rationing in construction, the cost of a construction resource consisting of a federal unit price in the base price level as of 01.01.2000 (order of the Ministry of Construction of Russia No. 519/pr dated 04.09.2019) should not correspond to the current price of this resource, taken into account in the contract estimate, taking into account inflationary processes in accordance with the schedule of construction works (order of the Ministry of Construction Of Russia dated 23.12.2019 No. 841/pr).
